Terms of Service

These Terms were written to be readable — not to trap you. Areas with significant legal implications are flagged with ⚠️. Ama Collective recommends that practitioners and users handling health or insurance information consult their own legal counsel.

1. Acceptance of Terms

By accessing or using amacollective.co and related services (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

We may update these Terms at any time. Material changes will be communicated by email or by a prominent notice on the Platform. Continued use after changes constitutes acceptance.

These Terms apply to all users, including expecting parents, gift-givers, meal train organizers, help calendar participants, and practitioners listed on the Platform.

2. What Ama Collective Is

Ama Collective is a platform that helps families prepare for pregnancy, birth, and the postpartum period. We provide:

• AI-powered baby registry creation and management

• Meal train coordination for new and expecting families

• Help calendar coordination for postpartum support

• A directory of practitioners (doulas, lactation consultants, pelvic floor physical therapists, and others)

• Content and guidance related to maternal and infant wellness

Ama Collective is a coordination platform — not a healthcare provider, insurance company, or medical service. Nothing on this Platform constitutes medical advice. Always consult a qualified healthcare professional for medical decisions.

3. Accounts & Eligibility

To create a registry or use certain features, you must create an account. You agree to:

• Provide accurate, complete, and current information

• Maintain the security of your password and notify us immediately of any unauthorized access

• Be at least 18 years old, or have parental/guardian consent

• Use one account per person (no sharing or transferring accounts)

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the Platform or other users.

4. Registry Services

Ama's AI-powered registry tool uses responses to a questionnaire and your stated values to suggest products and services. These suggestions are curated recommendations — not guarantees of quality, safety, or availability. We are not responsible for the products or services on your registry; each purchase is a transaction between you and the relevant retailer or service provider.

Sharing Your Registry You control who can view your registry. Public registries are accessible to anyone with the link. We are not responsible for how third parties use information from a public registry link you share.

Purchases Through Your Registry When a gift-giver purchases an item or contributes to a fund through your registry, the transaction is processed by Stripe. Contribution funds are held and disbursed according to the terms of your Stripe account. Ama Collective does not hold, custody, or guarantee funds.

Product Recommendations Some links may be affiliate links. We will disclose material affiliate relationships. Affiliate links do not affect the editorial independence of our recommendations.

5. Meal Train & Help Calendar Services

Meal trains and help calendars are coordination tools — they facilitate communication and scheduling between you and your supporters. Ama is not a food delivery service, meal preparation service, or home care service. We are not responsible for:

• The quality, safety, or suitability of meals prepared or delivered by supporters

• Allergic reactions or adverse events resulting from meals (though we provide allergen information tools to help organizers communicate needs)

• No-shows, missed slots, or disputes between organizers and supporters

• Actions taken by any person who accesses your meal train or help calendar link

Organizers are responsible for verifying that the information they share about the recipient is accurate. Sharing someone else's home address and personal information through a meal train or help calendar constitutes your representation that you have their consent to do so.

⚠️ Important: If you share a meal train or help calendar link publicly or with people you do not know, you are sharing a recipient's home address. We recommend sharing links only with trusted individuals.

6. Practitioner Listings

Ama may list practitioners — including doulas, lactation consultants, pelvic floor physical therapists, acupuncturists, and other perinatal care providers — on the Platform.

Important Disclaimers ⚠️ Ama Collective does not verify practitioner credentials, licenses, malpractice insurance, or professional standing. Listing on the Platform does not constitute an endorsement. You are responsible for independently verifying any practitioner's credentials before engaging their services.

⚠️ Ama Collective does not facilitate, broker, or guarantee any practitioner-client relationship. Any engagement between you and a practitioner is a direct relationship governed by your agreement with that practitioner.

⚠️ Insurance Coverage: The Platform may include tools to help families understand whether certain services may be covered by insurance. These tools are informational only and do not constitute insurance advice, a coverage determination, or a guarantee of reimbursement. Verify coverage directly with your insurance provider.

For Practitioners By listing on the Platform, you represent that: (a) you are legally authorized to practice in your jurisdiction; (b) your credentials and information are accurate; (c) you maintain appropriate professional liability insurance; and (d) you will comply with all applicable professional and legal obligations in your interactions with clients.

Practitioners should consult their own legal and malpractice counsel regarding their obligations under HIPAA, state licensing laws, and anti-kickback statutes before referencing insurance coverage or accepting referrals through any platform.

7. Payments & Refunds

Payment Processing All payments are processed by Stripe, Inc. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. Ama Collective does not store payment card information.

Registry Contributions & Funds Contributions to registry funds (e.g., doula funds, meal delivery funds) are processed immediately through Stripe. Ama Collective is a platform facilitator — we transmit funds to the recipient's connected account. We are not responsible for disputes between gift-givers and recipients.

Refunds Refund policies vary by transaction type. For product purchases fulfilled by third-party retailers, refunds are governed by the retailer's policy. For platform fees (if applicable), contact hello@amacollective.co within 30 days of the transaction.

Platform Fees We may charge platform fees for certain services. All fees will be disclosed clearly before any transaction is completed.

8. User Content & Data

Content You Provide You retain ownership of content you create on the Platform — registry descriptions, meal train messages, photos, and other materials ("User Content"). By submitting User Content, you grant Ama Collective a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely to operate and improve the Platform.

You represent that your User Content does not: violate any third-party rights; contain false, defamatory, or misleading information; include others' personal information without their consent; or violate any law.

AI-Generated Content Content generated by our AI (registry suggestions, chatbot responses) is provided "as is" and does not constitute professional advice. We make no warranties about the accuracy or completeness of AI-generated content.

Prohibited Conduct You agree not to: scrape or harvest data from the Platform; attempt to gain unauthorized access to any account or system; use the Platform to harass, threaten, or harm others; impersonate any person or entity; or use the Platform for any unlawful purpose.

9. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect, use, and protect your personal information as described in that Policy, including sensitive information such as home addresses, dietary restrictions, and payment data.

Given the nature of the information processed on this Platform, we take data security seriously. See our Privacy Policy for full details on our practices and your rights.

10. Disclaimers & Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be error-free, uninterrupted, or free of harmful components.

To the maximum extent permitted by law: • Ama Collective is not liable for indirect, incidental, special, consequential, or punitive damages • Our total liability for any claim arising from your use of the Platform shall not exceed the greater of (a) $100 or (b) the amount you paid to Ama Collective in the 12 months preceding the claim • We are not liable for the conduct of practitioners, meal train supporters, or other third parties connected through the Platform • We are not liable for medical decisions made in reliance on content from the Platform

Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., liability for fraud or gross negligence).

11. Indemnification

You agree to indemnify and hold harmless Ama Collective, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: your use of the Platform; your User Content; your violation of these Terms; or your violation of any third-party rights.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes arising from these Terms or the Platform will be resolved in the courts of California.
